An uncontested divorce is when a full agreement on the settlement terms is reached by the parties in advance. Accordingly, in order to qualify for an uncontested divorce, you and your spouse must be in complete agreement regarding property distribution, allocation of assets and/or debts, child support and custody. A disagreement on any one of these factors means your matter is contested.
Uncontested divorces are extremely popular because they are usually a cheaper and easier divorce option. An uncontested divorce generally enables you to minimize expenses while getting through the divorce much quicker. Also, it affords more privacy in that the negotiations spouses engage in are outside of the court and can remain private.
